NYT Editorial, Feingold Push Obama on State Secrets

The New York Times ran an editorial today chastising the Obama administration for defending the Bush position on state secrets in court. Sen. Russ Feingold (D-Wisc.), who chairs a Judiciary subcommittee on the Constitution, gave Obama a “D” grade on the issue. The new administration has asked to dismiss or limit three lawsuits so far, arguing proceedings would require public release of sensitive intelligence, national security and operational information. The cases: Al Haramain Islamic Foundation v. Obama, Mohammed v. Jeppesen Dataplan, and Jewel v. NSA.
