Baer, who is currently the head of Arnold & Porter LLP’s antitrust practice, is slated to come up for consideration again next week during the committee’s weekly business meeting. Delaying a vote is common practice within the committee. If approved by the judiciary, Baer’s nomination will move to the full Senate for consideration.

Baer was nominated to take the helm of the Antitrust Division in February, and he testified before the Senate Judiciary Committee in July.

Baer previously served as Director of the Bureau of Compeittion at the Federal Trade Commission from 1995 to 1999, after beginning at the FTC as a trial attorney working on consumer protection.
